Terms and conditions 

1.Your contract with us 

The hire contract between the Hirer (hereafter “you”) and Nomadic Scotland Ltd, (hereafter “us” or “we”). Please read this agreement carefully. If there is anything you do not understand please don’t hesitate to contact us for clarification. The contract is non-transferable.

2.Booking confirmation, charges and payment 

You must pay a booking deposit of 40% to confirm the booking. This deposit contributes towards your total booking cost. By paying this deposit you are accepting these terms and conditions and a binding contract for the hire will come into existence. A booking confirmation/invoice will be sent to you reflecting the rental period and the rental charge. The Deposit must be paid within 24hrs of receiving the invoice. 

Your full rental balance is payable four weeks prior to the start date of your hire, or immediately if you book less than four weeks in advance. Failure to make full payment on the date due may result in your booking being cancelled. In this event your initial deposit will be non-refundable. In entering this agreement, you accept (a) to pay all charges due in accordance with the Terms and Conditions of the Hire and (b) that we are entitled to charge any credit or debit card used by you during the hire transaction for payment of any such outstanding charges. 

3.Cancellations 

All cancellations must be notified in writing. 

Please let us know as soon as possible if you are unable to proceed with your booking date due to exceptional/unforeseen circumstances. We will endeavour to rearrange your trip; however, this is not always possible or guaranteed and we do not offer refunds for cancellations. 

Gift vouchers are non-refundable. 

4.Licence requirements & Identification  

You must have one of the following license types. 

Full UK, EU, AU, US, CA, NZ, SA and have at least 2 years driving experience. (Please contact us before you book for any other type of license) 

You must be between 23 & 70 Years of age. 

We will require the following identification before collection of the vehicle. (within 21 days)

  • Passport (International customers only)
  • Valid car License  (Photo Type)
  • Valid DVLA License check (UK Only) https://www.gov.uk/view-driving-licence (When you generate the code, press print, then share the PDF with us)
  • 2 x Proofs of address from separate sources, must be within 90 days. 
 

Acceptable Proofs of address types 

  • Electricity, Water, Gas, Broadband, Council tax, Bank, Credit card, Mortgage, Car Finance, Mobile phone, HMRC self-assessment (bills/statements)

If you have a UK License and have penalty points, then the following rules apply.

  • Two, 3-point convictions are acceptable (i.e., 2x SP30’s, 3pts each) .
  • Single 4-point offences are acceptable.
  • Single 6-point SP30, SP50 and CU80 convictions are acceptable subject to a £2000 excess.
  • Single 6-point offence (MS90, IN10) Please let us know, we will have to refer this to the insurer.
  • All other 6 points+ offences will require referral to the insurers

If you have previously been banned from driving please let us know.
No more than one fault or outstanding incident/claim in the last three years.

 5.Insurance  

We provide fully comprehensive insurance with all our hires. The insurance excess is £1500. We will only claim on our insurance policy if we deem this appropriate. For example, a scratch or dent caused by you will not necessarily be claimed via the insurance, you will be liable for any damage caused to the vehicle. A standard charge of £300 will be applied per panel if you scratch the vehicle and it requires repainting. Any other types of damage for example large dents will result in the loss of your deposit. 

The insurance is valid for 2 drivers and for the period of the hire from the specified collection date and time to the specified date and time of return. You will be liable for all costs and expenses incurred for speeding, parking fines, congestion charges, or any other offences committed against the Road Traffic Act or other traffic regulations, and you agree to indemnify the company from any liability. 

The vehicle insurance company do not cover off road driving accidents, this is not permitted, and you will be held liable in full for any damage caused to the vehicle if it is used for these purposes. 

All of our vehicles are fitted with Tracking and telematics technology for insurance purposes. 

The Road Traffic Act 1988 states that you can drive a vehicle off-road – away from a public road – for the purpose of parking and within 15 yards of a public road. Landowner permission does need to be sought for private land. Please always use care and caution when driving on uneven surfaces. Operating outside of these guidelines will render the vehicle insurance nil and void and therefore you will be personally liable for any damage or theft to the vehicle even if this is more than the insurance security deposit. You will not be insured and will be personally liable if the vehicle is used for the purpose of off-roading, i.e., driving through rivers/fields/bogs/beaches etc. If evidence is found via the telematics system or other indicators such as excessive mud and long grass stuck underneath the car your security deposit may be retained until a thorough inspection has been carried out to ascertain if there has been any damage caused. 

6.Security Deposit 

On collection of the vehicle a security deposit of £1500 (equivalent to the insurance excess) is required. It must be paid by credit /debit card. We will Pre Authorise your card to the value of £1500. 

On collection of the vehicle, we will check for damage and note any that exists, on return we will do the same, if there is any additional new damage when you return then your deposit will be held until a repair quotation has been sought. Upon this quotation you will be liable to pay the amount up to the value of the insurance deposit, including an admin fee of £50. For any damage caused to the roof tent you will be liable for the whole amount of the repair or replacement which may be over the value of the insurance deposit subject to the damage caused. For any damage to the camping equipment, beyond normal wear and tear you will be charged the value of the item.

General wear and tear is excluded such as stone chips to the front of the vehicle. 

You will be liable for any parking fines that are received in relation to your booking, these will be deducted from you security deposit, or in the instance that these are received after the deposit has been released you will be invoiced for this charge. An admin fee of £25 will be added to all parking tickets.

7.Mileage 

Up to 120 miles per night are included free in the daily rental charge. Any miles over 120 per night will be charged at £0.80p/mile. (Example 5-night rental = 600 Miles free) 

8.Collection and Return Times 

Unless otherwise agreed in writing, the vehicle will be available at our collection point in Perth on the day of collection at 10.00 AM and must be returned by 12 Noon on the last day of hire. You should allow up to one hour for the hand–over on collection and return. Unauthorised late returns will be charged at the rate of £25.00 per hour for each hour or part thereof that the vehicle is returned late plus any transport or other costs incurred by us in ensuring its safe return. 

9.Fuel, and Daily Maintenance 

Fuel is at your expense. You must ensure that you use the correct fuel (Diesel), and that the vehicle is returned with a similar amount of fuel as was present when it was collected. Any shortfall will be estimated and charged at current rates. It is your responsibility to check basic visual maintenance items such as Tyre inflation levels on a daily basis and, if necessary, to take appropriate actions to avoid unnecessary damage to the vehicle. If in the unlikely event that the temperature gauge rises above the halfway mark, please stop immediately where it is safe to do so and contact us, driving a vehicle which may be overheating can cause significant engine damage. Normal wear and tear is fine however if you cause damage to the vehicle engine or running gear (Clutch/gearbox/transfer box etc) due to negligence or improper driving then you will be held liable for the cost of the repair. 

10.Vehicle Events Beyond Our Control 

Unfortunately, events beyond our control (i.e., events which we could not, even with due care, foresee or avoid) could possibly affect vehicle availability such as a mechanical breakdown or similar preventing the vehicle being available for hire on the date booked or during the hire period. We cannot accept responsibility or pay compensation, costs or expenses where the performance of your contract with us is prevented or affected, or you otherwise suffer any loss as a result of events beyond our control. However, if you are unable to commence your rental as a result of such events caused by us then we will offer you a full refund of all monies received for your booking, without further liability. 

11.Breakdowns, Repairs & Accidents 

Despite regular quality control checks, occasional problems can still arise with the vehicles. In the event of an accident, break-down or technical difficulties (including problems with Tyres), you must inform us immediately on the telephone number 07506672749 (leaving a voice or text message if unable to connect). In the event of an accident, the police must be contacted on telephone number 999 and Nomadic Scotland must be informed as soon as possible. Third party demands are not to be agreed to and the police report must include the name and address of the people involved as well as any witnesses, along with all vehicle registration details. Even in the case of minor damage you are required to provide a detailed written report to Nomadic Scotland outlining the circumstances of the accident. 

NOTE: If you do not inform Nomadic Scotland immediately about the need for a repair and if we are not given the opportunity to help find a solution, no compensation will be provided. If you inform Nomadic Scotland about any vehicle problems after the vehicle has been returned, but without having informed them during the rental period no compensation will be provided. 

If the vehicle is out of action due to a mechanical breakdown* (not an accident) for longer than 12 hours, through no fault of yourself, our responsibility is limited to refunding the nightly rental rate or portion thereof covering the period from when the fault was initially notified to us until a repair has been completed. 

12.Additional Responsibilities 

You must look after the vehicle and its contents (including any keys) and ensure that it is always locked. You must always protect the vehicle/tent from bad weather which may cause damage (i.e., excessive wind). You are responsible for any damage to the vehicle caused by hitting rocks or low branches. We shall not be liable for loss or damage to any property left, stored or transported by the hirer or by any other person in a vehicle during the period of the rental. You agree to hold us harmless from and indemnify us against all claims based upon or arising out of such damage. 

The tent manufacturer states that the equipment has been tested up to 35 MPH winds. Wind speeds greater than this may cause damage to you/and or the equipment. Nomadic Scotland will not be held liable for any damages to the tent or equipment if it has been used in extreme weather conditions. Please note you are responsible fully for any damage caused by high winds.

You must not sell, rent, dispose of, or give anyone any legal rights over the vehicle or any of its parts or contents. You must not allow anyone to work on the vehicle without our permission. 

You are responsible for ensuring any children have appropriate car seats to comply with Scottish law. We have a limited range of car seats available, but cannot always guarantee that the correct seat will be available for your child. 

13.Return of Security Deposit 

We will not make a charge (Authorise) on your card at the end of the hire period provided the vehicle and equipment is returned to us in a satisfactory condition and at the location and date and time agreed. Satisfactory condition includes clean, undamaged, with all tools, accessories and equipment in the same condition as when collected and having been operated in a reasonable manner. 

(Please be aware a Pre-Authorised card can remain as such for different lengths of time depending on your own bank) 

In the event that damage charges apply, you will be liable to cover these up the the value of the insurance deposit for the vehicle and in full for the roof tent regardless of the security deposit value. We will change your card deposit status from Pre-Authorised to Authorised. 

14.Smoking 

It is illegal to smoke or allow smoking in a hired vehicle in the UK (even with the window open). Any infringement will incur a charge of a £100.00 and leave you liable to prosecution and a fine of up to £1000.00 

15.Cleaning 

If the vehicle is returned in a poor state of cleanliness inside, then cleaning charges may be applied. 

16.Storage of Hirers Own Vehicle 

Parking is available free of charge to you for the duration of the hire period at the vehicle owner’s own risk. 

17.Ending the Agreement 

We will end this agreement immediately and repossess the vehicle if the vehicle is being used irresponsibly, this includes excessive speeding and off-road driving. No refund will be given for any remaining nights.

We will also end this agreement and repossess the vehicle if you do not meet any of the conditions of this agreement or have obtained the vehicle through fraud or misrepresentation, or the vehicle appears to have been abandoned. If you are a company, we will also end this agreement Immediately and repossess the vehicle if you go into liquidation or you call a meeting of creditors. 

If we end this agreement, it will not affect our right to receive any money we are owed under the conditions of this agreement. 

18.Changes in Terms and Conditions 

We reserve the right to alter the rates and conditions at any time. Our website will have the most up to date T&Cs. 

19.Governing Law 

This agreement is covered by the laws of Scotland. Any dispute may be settled in the courts of that country.
